Terms of Service

1. Who we are
Clara Deeds ("Clara Deeds," "we," "us") is a trading name of BALI HOME DESIGNS, SLU, a company registered in the Principality of Andorra under registration number 27593, with its registered office at Carrer Esteve Albert, Edifici La Roureda, Bloc A, 1r Pis, 2a Porta, Santa Coloma, Andorra. These Terms of Service ("Terms") govern your use of claradeeds.com and your purchase of a Clara Deeds property due diligence report (the "Service"). By placing an order, you agree to these Terms.
Clara Deeds is not a law firm, does not provide legal advice, and does not act as your attorney, notary, or agent in any property transaction.
2. The Service
Clara Deeds reviews documents you provide, together with information available in the relevant public property registry, and returns a written report covering some or all of: survey, title, zoning, sale contract, outstanding debts, and environmental setbacks, ending in an overall GREEN/AMBER/RED risk rating. Which checks are included depends on the package you purchase.
Reports are delivered by email as a digital document. There is no physical product and no ongoing subscription — each order is a one-time purchase of a single report.
Reports reflect our review of the documents you submitted and publicly available registry records as of the date of analysis. They are not a guarantee of title, an insurance product, or a substitute for the independent legal and notarial review required to actually close a property purchase in Costa Rica or Panama.
3. Eligibility and your account information
You must be at least 18 years old to place an order. When you order, you agree to provide accurate contact and property information, and to keep us informed if anything material changes before your report is delivered (for example, an error in your email address).
4. Orders and payment
Prices are shown in US dollars and are payable in full at the time of order. Payment is processed by PayPal, our payment processor. PayPal is not the merchant of record for your purchase: your payment contract for the Service is with us, BALI HOME DESIGNS, SLU, not with PayPal. PayPal handles the payment transaction itself, subject to PayPal's own user agreement, alongside these Terms. We never see or store your full card or bank details — PayPal shares with us only confirmation that payment was made, the amount, and a transaction reference.
5. Sending your documents
After payment, we will email you at the address you provided with the list of documents needed for your package (for example, survey, title, or contract documents). Reply with those documents attached, or send them to hello@claradeeds.com referencing your order. You are responsible for:
- only sending documents you have the right to share with us for this purpose; and
- the accuracy and completeness of what you send us.
Analysis cannot begin — and your report cannot be delivered — until we have everything required for your package.
By sending us a document, you grant us a limited license to use it solely to prepare your report. We do not sell your documents or use them for any purpose beyond delivering the Service, subject to our Privacy Policy.
6. Delivery
We aim to deliver your report within 48 hours of receiving every document required for your package. This timeline depends on us actually having what we need — it does not start at the time of payment. If we have questions about your submission, we will contact you at the email address you provided, which may extend this timeline.
7. Refunds
Our refund terms are set out in our Refund Policy, which forms part of these Terms.
8. Report ownership and permitted use
Once delivered, you may use your report for your own personal or business purposes in connection with the property it covers. We retain all intellectual property rights in our report format, methodology, and any Clara Deeds branding. You may not resell, publicly republish, or represent our report as your own work product.
9. No legal advice; limitation of liability
Clara Deeds reports are informational only and do not constitute legal, tax, or financial advice, and do not create an attorney-client or fiduciary relationship of any kind. You remain responsible for obtaining independent legal and notarial advice before committing to any property purchase.
To the maximum extent permitted by law, Clara Deeds' total liability arising out of or relating to an order is limited to the amount you paid for that order, and we are not liable for any indirect, incidental, or consequential loss, including any loss relating to a property transaction you enter into or decline to enter into.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded, including liability for fraud or for death or personal injury caused by our negligence.
10. Privacy and data protection
Our handling of your personal data and the documents you send us is described in our Privacy Policy.
11. Changes to these Terms
We may update these Terms from time to time. Changes apply to orders placed after the updated Terms are posted on this page; they do not apply retroactively to an order already in progress.
12. Governing law
These Terms are governed by the laws of the Principality of Andorra, without regard to conflict-of-law principles. Any dispute not resolved informally is subject to the exclusive jurisdiction of the courts of Andorra, except where applicable consumer protection law gives you the right to bring a claim in your own place of residence.
